1.1 Kalaax.com (the “Platform”) is an online marketplace for automotive spare parts and related products, accessible via www.kalaax.com and any Kalaax mobile application(s).

1.2 The Platform is owned and operated by Parts Hub e-commerce L.L.C. a company organized under the laws of Egypt (“Kalaax”, “Company”, “we”, “us”, “our”).

1.3 These Terms and Conditions of Use (“Terms”) govern your access to and use of the Platform and any services made available through it.

2.1 These Terms form a legally binding agreement between Kalaax and any user (“you”, “User”), whether acting as a consumer or on behalf of a business.

2.2 By accessing or using the Platform, creating an account, placing an order, listing products (if applicable), or otherwise using any feature, you agree to be bound by these Terms and our policies referenced herein (including the Privacy Policy and Return/Refund Policy).

2.3 If you do not agree, do not use the Platform.

3.1 You must be at least 18 years old to use the Platform. If you are under 18, you may use the Platform only under the supervision and responsibility of a parent/legal guardian.

3.2 If you use the Platform on behalf of a company or other entity, you represent you have authority to bind that entity.

4.1 Marketplace role: Kalaax provides a technology platform that facilitates transactions between buyers and independent sellers/suppliers (“Sellers”). Unless explicitly stated otherwise, Kalaax is not the manufacturer and not the seller of items offered by Sellers.

4.2 Product pages & catalog data: Fitment/applicability information may be based on catalogs, vehicle data, or third-party sources and may not be error-free.

5.1 You may need an account to access certain features. You agree to provide accurate, current, and complete information and keep it updated.

5.2 You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

5.3 Kalaax may suspend or terminate accounts that provide false information, misuse the Platform, or breach these Terms.

6.1 Kalaax aims to make finding and purchasing spare parts easier through continuously updated product listings and vehicle fitment tools.

6.2 “Can’t find your car in the catalogue?” Vehicle/catalog additions may take 30–90 days depending on data availability and verification.

6.3 Kalaax does not guarantee that any item shown will be available at the time of order confirmation, and cannot guarantee exact delivery timelines.

7.1 Prices, availability, delivery timelines, and offers may change without notice.

7.2 If a product is listed with incorrect information or pricing due to an error, Kalaax and/or the Seller may cancel the order and refund any amounts paid (if applicable) or request confirmation to proceed at the correct price.

7.3 Kalaax may cancel orders for reasons including suspected fraud, stock unavailability, technical errors, or address/phone verification failures.

8.1 Payment methods may include Cash on Delivery (COD) and other methods offered on the Platform (card, wallet, bank transfer, etc., where available).

8.2 COD: You agree to pay the full invoice amount at delivery. If you refuse delivery without a valid reason permitted by the Return/Refund Policy, Kalaax may restrict COD access for your account and/or apply any disclosed delivery/restocking charges (if shown at checkout or in the Return/Refund Policy).

8.3 If you pay online, payment processing may be handled by third-party payment providers; Kalaax does not store full card details.

9.1 Delivery times are estimates and may vary due to courier capacity, customs (if applicable), traffic, address accuracy, or unforeseen events.

9.2 Risk of loss and title may pass according to the applicable seller terms and the Return/Refund Policy.

10.1 Returns/refunds are governed by the Return, Cancellation and Refund Policy available at Return & Refund Policy.

10.2 Where there is a conflict between these Terms and the Return/Refund Policy for returns/refunds, the Return/Refund Policy prevails.

11.1 Automotive parts installation can be hazardous and may require professional tools and expertise. Always consult a qualified mechanic/workshop before installation.

11.2 Kalaax does not guarantee compatibility/fitment based solely on vehicle selection, VIN, or catalog matching. You are responsible for verifying suitability before purchase and installation.

11.3 Kalaax is not responsible for damage, injury, or losses arising from incorrect installation, misuse, or selection of parts.

12.1 You agree not to misuse the Platform or attempt to interfere with its security or operation, including by:

• violating applicable laws or regulations;
• submitting false or misleading information;
• attempting unauthorized access to accounts, systems, or data;
• scraping, crawling, reverse engineering, or using automated tools except where expressly permitted;
• transmitting malware, spam, or abusive content;
• posting content that infringes rights, is defamatory, harassing, hateful, or unlawful.

13.1 Product descriptions, images, fitment notes, and other content may be provided by Sellers and third parties. Kalaax does not guarantee completeness, accuracy, or legality of third-party content.

13.2 Links to third-party websites or services are provided for convenience; Kalaax is not responsible for them.

14.1 “Kalaax”, the Kalaax logo, and Platform design/content are owned by Kalaax or licensed to Kalaax and protected by applicable IP laws.

14.2 Vehicle brand names, model names, trademarks, and logos are the property of their respective owners. Kalaax does not claim affiliation with OEMs unless explicitly stated.

14.3 You may not copy, reproduce, distribute, or exploit Platform content except for personal, non-commercial use as permitted by law and these Terms.

15.1 If you submit content (reviews, images, text), you confirm you have the right to share it and it does not violate any law or third-party rights.

15.2 You grant Kalaax a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and adapt such content for operating and promoting the Platform (unless prohibited by law).

16.1 Your use of the Platform is subject to our Privacy Policy at Privacy Policy.

16.2 Kalaax may process personal data to operate the Platform, prevent fraud, fulfill orders, provide customer support, and meet legal obligations, in line with applicable data protection laws.

17.1 The Platform and services are provided “as is” and “as available”. To the maximum extent permitted by law, Kalaax disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

17.2 Kalaax does not warrant uninterrupted or error-free operation of the Platform.

18.1 To the maximum extent permitted by law, Kalaax shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

18.2 Where Kalaax is not the seller of record, your primary remedy for product issues lies against the Seller.

18.3 If liability cannot be excluded, Kalaax’s total aggregate liability shall be limited to the amount of fees actually paid to Kalaax (if any) for the specific transaction.

19.1 You agree to indemnify and hold harmless Kalaax, its directors, employees, agents, and affiliates from claims arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party rights.

20.1 Kalaax may suspend or terminate your access (and/or account) immediately if we reasonably believe you violated these Terms, engaged in fraud, abused returns/COD, or created risk for the Platform or other users.

20.2 Sections intended to survive termination (including IP, disclaimers, limitation of liability, indemnity, dispute resolution) shall survive.

21.1 Kalaax may update these Terms from time to time. Updated Terms become effective upon posting on the Platform.

21.2 Continued use after changes means you accept the updated Terms.

22.1 These Terms are governed by the laws of Arab Republic of Egypt, excluding conflict of law principles.

22.2 Disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be submitted to the competent courts of Cairo / agreed governorate.

23.2 Kalaax may contact you via phone, SMS, email, or in-app notifications for order fulfillment, support, fraud prevention, and service communications.

24.1 If any provision is found unenforceable, the rest remains in effect.

24.2 You may not assign your rights under these Terms without Kalaax’s written consent.

24.3 Nothing creates an agency, partnership, or employment relationship between you and Kalaax.

25.1 Product images may be illustrative and may not perfectly represent packaging, labels, or minor design variations. Always check part numbers, specs, and compatibility.
